최근 노인복지 생활시설 옴부즈맨 프로그램의 필요성에 대한 인식이 늘어나면서 옴부즈맨프로그램의 제도 도입가능성을 적극 검토할 필요가 있다. 본 연구는 옴부즈맨프로그램과 관련하여 우선, 옴부즈맨의 개념과 전개과정, 외국의 노인복지생활시설옴부즈맨현황을 살펴보았고 둘째, 현재까지 우리나라에서 실시된 노인복지생활시설 옴부즈맨 프로그램 사례를 제시하였으며 셋째, 노인복지생활시설 옴부즈맨 프로그램 제도 확립에필요한 공통적 기능 요소인 공적 승인 및 의무설치, 전문성, 조사권, 그리고 조정ㆍ지도ㆍ권고기능을 분석틀로 삼아 분석하였다. 연구결과 현재 우리나라에서 노인복지생활시설 옴부즈맨 관련 사업은 공적 승인 및 의무 설치가 되지 않았고 전문성, 조사권, 그리고 조정ㆍ지도ㆍ권고기능 등이 제대로 이행되지 못하는 초보수준에 머물러 있었다. 따라서 노인복지생활시설 옴부즈맨사업을 발전시키기 위해서는 우선적으로 정부로부터 인준을 받는 옴부즈맨프로그램 운영기구(사무국)의 설치가 필요하며, 둘째 지역사회 중심의 옴부즈맨 구성 및 전문성 증진, 그리고 조사권한 제공이 필요하며, 마지막으로 중앙정부와 지자체, 지역 내 민간기관, 그리고 생활시설 등으로 구성된 옴부즈맨조정위회에서 옴부즈맨 조사결과의 검토, 권고 및 개선조치를 수행하는 운영체계를 갖출 필요가 있음을 제시하였다.
Recently, the Ombudsman system has been widely considered as anecessary programme in the elderly care facilities(assisted livingfacilities). Thus, the implementation of Ombudsman programmesin the elderly care facilities should be examined. This study is toreview the policy development of Ombudsman programs in nationaland international circumstances. Secondly, this article providesthe case study of Ombudsman program where some elderly carefacilities have already operated the program. Thirdly, the researchanalyzes the Ombudsman system in terms of official approval,mandatory implementation, the right of investigation, professionalism,and the functions of coordination, guidance andrecommendation. The Ombudsman program, as presently constituted,has no coercive powers. As a result, this paper suggeststhat there should be established an state organization orinstitution(such as 'Elderly Ombudsman Agency') for the elderlyabuse screening affairs. Secondly, the 'Elderly Ombudsman Agency'will be legally authorized to investigate elder abuse cases.Moreover, the agency has to community based institution and itcan have the rights to consist a member of Ombudsmen. Finally,there should be a conciliation committeetheindividual representativesfrom central government, local government, human rightsorganizations and the elderly care facilitieswhichcan take legalactions to improve regulatory measure and recommend measuresbased on the assessment of elder abuse cases.
